
The Supreme Court is poised to deliver its verdict on Delhi Chief Minister Arvind Kejriwal’s interim bail plea related to the excise policy case on Friday, May 10. Justice Sanjiv Khanna, leading the bench handling the matter, indicated that the court would announce its decision on Kejriwal’s temporary bail application this week.
The case revolves around Kejriwal’s request for interim bail amidst the ongoing general elections. While the court signaled openness to grant interim bail, concerns were raised about allowing Kejriwal to perform his official duties as the Chief Minister during the bail period, citing potential conflicts.
During the proceedings, the Enforcement Directorate (ED) urged the court not to grant bail to Kejriwal, arguing against treating politicians differently from ordinary citizens in matters of bail. However, acknowledging the unique circumstances of the ongoing elections and Kejriwal’s position as both the CM and AAP convener, the court considered the request for interim bail.
The bench, including Justice Dipankar Datta, expressed reservations about Kejriwal handling official duties while on bail, citing concerns about interference in government operations. Senior counsel Abhishek Manu Singhvi, representing Kejriwal, agreed that Kejriwal would refrain from signing official files during the bail period if the Lieutenant Governor (L-G) did not impede government proposals due to the absence of the CM’s signature.
The court reserved its order on interim bail, emphasizing the need to review all relevant case files and formulate a clear opinion. Meanwhile, the ED continued to oppose Kejriwal’s plea, highlighting concerns about creating special considerations for political leaders during elections.
The case stems from allegations of irregularities in Delhi’s excise policy, with the Central Bureau of Investigation (CBI) initiating an investigation following a recommendation by Delhi’s LG in July 2022. Kejriwal, currently in judicial custody, is the third AAP leader arrested in connection with this case.
The court’s decision on interim bail is eagerly anticipated, especially with the upcoming general elections and the subsequent announcement of results. The case underscores the complexities of legal proceedings involving high-profile political figures during critical electoral periods.
