A court in Delhi has issued a summons to food delivery giant Zomato in response to a civil suit alleging deceptive practices in its delivery services. The suit seeks a restraining order against Zomato, accusing the company of misleading users by claiming to deliver “hot and authentic food” from renowned restaurants across the national capital under its sub-category “Dilli ke Legends.”

The court’s decision came after a Gurugram resident, Sourav Mall, filed a plea claiming that Zomato was engaging in “false and fraudulent” practices by delivering fresh food from well-known eateries. Mall’s plea highlighted an instance where he ordered from three different iconic restaurants, only to discover that the food was picked up from an “unknown and unnamed” location instead of the original restaurants.

The plea raised significant concerns regarding the authenticity and quality of the delivered food, questioning why the food wasn’t delivered in its original packaging and expressing doubts about whether it was prepared by the designated restaurant partners. Additionally, Mall’s plea questioned the feasibility of Zomato’s claims of delivering from iconic Delhi restaurants to locations in Gurugram and Noida within 30 minutes.

Described as a “representative suit” under the Code of Civil Procedure (CPC), the plea aims to address the concerns of numerous affected individuals who may have fallen victim to similar deceptive practices by Zomato. It accuses the company of deceiving the public by misrepresenting the origin and quality of the food being delivered.

The court has scheduled further proceedings on March 20 to address the matter. This legal action underscores the growing scrutiny faced by food delivery platforms like Zomato, highlighting the importance of transparency and accountability in their operations to ensure consumer trust and safety.
